Muqātil (. Oaths (3,548 words)
Solemn assertions or promises. In English the word «oath» has various related senses. One usually involves using the name of God, or of some other revered or dreaded being, object or place, in order to give force and solemnity to an utterance (an assertion, promise, denial, curse, etc.). Oaths of this type, where a statement includes a phrase such as "by God, " "by the stars when they set, " "by this land, « etc., are common in the Qurʾān. Many such oaths occur in sūras traditionally regarded as having been among the earliest to be revealed, and their compressed grammar and unusual vocabulary pose difficulties of comprehension (see grammar and the qurʾān; language and style of the qurʾān). Understood as communications of God himself, there are nevertheless examples (e.g. q 4:65; 16:63) where they are made „by God“ (tallāhi) or „by your lord“ (q.v.; wa-rabbika). The fact that God uses oaths in the Qurʾān is taken to be among the proofs of its inimitability (q.v.; cf. Suyūṭī, Muʿtarak, i, 449-55). The interpretation of oaths to natural phenomena, such as stars (see nature as signs; planets and stars), which occur in early sūras (see chronology and the ¶ qurʾān), has posed problems for exegetes (see exegesis of the qurʾān: classical and medieval; see also Kandil, Schwüre; Neuwirth, Images). Muqātil (d. 150/767) explains the oath of q 53:1 („by the star when it sets“) as referring to the time that elapsed between revelations; the Qurʾān itself is therefore called „ najm“ (Tafsīr, iv, 159; cf. Ibn Qayyim al-Jawziyya, Tibyān, 161; al-Farrāʾ, Maʿānī, iii, 94). Later exegetes, such as al-Suyūṭī (d. 911/1505; Itqān, iv, 53-9), explain these oaths as following the custom of the Arabs (q.v.): as the Qurʾān was revealed in the language of the Arabs, it adopted their formulaic expressions (see arabic language; language, concept of). The problematic is further complicated when the style of these formulaic expressions is examined: for, stylistically, these oaths have been understood to be akin to the rhymed prose (q.v.) of the pre-Islamic soothsayers (q.v.; see Ibn al-Naqīb, Muqaddima, 238-9; cf. Nöldeke, gq, i, 60, 75; Wellhausen, Reste arabischen Heidentums, 135; see also poetry and poets), yet the Qurʾān denies that Muḥammad is a soothsayer. Finally, sometimes these oaths appear in the reported speech of, for example, Abraham (q.v.; q 21:57: „By God, I shall set snares for your idols“; see idols and ¶ images) or the sons of Jacob (q.v.) in Egypt (q.v.; q 12:73: „By God, you know that we did not come to commit evil in the land…“). A second type of oath is typically a statement or promise guaranteed by calling upon a revered being or object as a witness, usually made to another person or party, often in a formal legal or quasi-legal context (see witnessing and testifying; law and the qurʾān). It is common to distinguish between an oath in this sense and a vow, a promise to do or avoid something, which may be made directly to God or some other being and may be made privately and internally. Inasmuch as the words of a vow, however, tend to follow fixed formulae, may involve other human beings, and may invoke the name of the being to whom it is being offered, the distinction between an oath and a vow is not always clear. There are some cases in the Qurʾān — and outside it — where derivatives of the root y-m-n (usually understood in connection with oaths) may be equally understood as referring to vows (see the discussion of al- laghw fī aymānikum below). Vocabulary and types of oaths The most common words indicating swearing and oaths in the Qurʾān are derivatives of the roots y-m-n, ḥ-l-f, and q-s-m. They seem to be used interchangeably and often jointly in expressions such as „oaths which you have sworn“ (aymānikum idhā ḥalaftum, e.g. q 5:89) or „they swear a solemn oath by God“ (aqsamū bi-llāhi jahda aymānihim, e.g. q 6:109). The root q-s-m, which is associated with the notion of dividing and apportioning, as well as with swearing and oath taking, is used both in connection with the oath as a forceful statement (q 56:75-6: „I swear [fa-lā uqsimu] by the setting of the stars and that indeed is a mighty oath [ qasam], if only you knew“), and with it in relation to legal matters ¶ (q 5:106-7 recommends that when making a will two just men should be chosen as witnesses and asked to swear — yuqsimān — that they will not act corruptly). The references in q 2:67-71 to the cow which God commanded the people of Moses (q.v.) to slaughter are sometimes explained by exegetes in connection with the group oath known in Islamic law as the qasāma, which is not attested by name in the Qurʾān. On the other hand, nadhara and nadhr, understood more in connection with vows, occur independently and on some occasions clearly refer to the promising of a pious act to God: in q 19:26Mary (q.v.; Maryam) says, „I have sworn/vowed a fast (nadhartu… ṣawman) to God“ (see fasting); in q 3:35ʿImrān’s (q.v.) wife, pregnant with Mary, says to God, „I have sworn/vowed (nadhartu) to you what is in my womb as a consecrated offering.“ The bayʿa (giving allegiance or entering a contract of clientage) may also be understood as a form of oath (see contracts and alliances). The noun bayʿa itself does not occur in the Qurʾān but there are a number of cases where the third form of the verb is used, and q 48:10 makes it clear that it involves a ritual acceptance of God’s representative as one’s patron (see clients and clientage): „Those who offer allegiance to you (yubāyiʿūnaka) do so to God. God’s hand (q.v.) is over theirs [an allusion to the hand clasp involved in such contracts]. Whoever betrays his oath (man nakatha) only betrays himself but whoever fulfils what he has contracted to God (awfā bimā ʿāhada ʿalayhu llāha), he will grant him a tremendous reward.“ Two other procedures mentioned in the Qurʾān are related to swearing oaths and making vows. They involve a man renouncing sexual relations with a woman or women who would normally be available to him. q 2:226-7 says that those who swear ¶ or vow not to have relations with their wives (lilladhīna yuʾlūna min nisāʾihim) should wait for four months. If they revert (fāʾū) [i.e. resume relations?], God is forgiving and merciful; if they decide on divorce, he is all-hearing and all-knowing» (see marriage and divorce; abstinence; chastity). Outside the Qurʾān the word īlāʾ is used with reference to a vow of (temporary) abstention from a certain woman or women. If the abstention lasts longer than months, the man must either divorce the woman or resume relations with her (see sex and sexuality). The vow is made invoking one of the names of God (see god and his attributes) and is subject to an act of atonement (kaffāra) if broken. Some commentators say explicitly that yuʾlūna means yaḥlifūna. q 33:4 and q 58:2-3 refer unfavorably to the practice whereby a man makes a wife sexually unavailable to him by ẓihār — a noun which does not occur in the Qurʾān, but is implied in the use of the related verb form in such phrases as azwājakumu llāʾī tuẓāhirūna minhunna (q 33:4) and alladhīna yuẓāhirūna minkum min nisāʾihim (q 58:2). Commentators explain that this practice involved the man putting the woman in the category of those prohibited to him for sexual relations (see prohibited degrees) by saying to her, "You are to me as the back (ẓahr) of my mother, " where «back» has a sexual connotation. Although this is not strictly an oath or vow, it does involve the use of a ritual formula and is subject to acts of atonement (listed in q 58:3-4) which are more severe than those laid down in q 5:89 for the breaking of (other?) types of oath. Vocabulary used in connection with the breaking of oaths includes n-k-th (explained as metaphorical use [see metaphor ] of its literal association with unraveling or untwisting the fibers of a garment or a wooden toothpick, siwāk) and n-q-ḍ. Ḥ-n-th,¶ which is used outside the Qurʾān often as a technical term in connection with breaking or incurring liability for oaths (see breaking trusts and contracts), but also more generally in the sense of «sin» (see sin, major and minor), occurs twice: in the story of Job (q.v.; q 38:44) we are told that God ordered him lā taḥnath, which some commentators understand as "do not break your oath, " while in q 56:46 persisting in al- ḥinth al-ʿaẓīm is mentioned as the sin of those consigned to hell (see hell and hellfire). The opponents' oaths Many references concern the oaths that the opponents (mushrikūn, munāfiqūn [see belief and unbelief; polytheism and atheism; idolatry and idolaters], « People of the Book» [q.v.], and others; see also opposition to muḥammad) make, falsely, insincerely, or for worldly gain. «[The munāfiqūn] would come to you swearing by God that that they only wanted benificence and reconciliation (iḥsānan wa-tawfīqan)» (q 4:62); «on the day when God will raise them all together they will swear to him as they swear to you… but they are liars» (q 58:18; see resurrection; lie); «the mushrikūn swear by God one of their strongest oaths that they will believe if a sign (see signs) comes to them. Say: The signs are with God alone…» (q 6:109). «Those who barter God’s covenant (q.v.) and their oaths for a small price» (q 3:77) is often associated with the Jews (see jews and judaism) and sometimes understood to refer to the swearing of a false oath (yamīn fājira) in order to obtain property illegitimately. Satan (see devil) is reported to have sworn to Adam and Eve (q.v.; qāsamahumā) that he was a good adviser to them (q 7:21). q 68:10 refers to the unidentified opponents as ḥallāf mahīn, «despicable swearer of oaths.» Subsequently (q 68:17-33), their ¶ fate is compared to that of the unspecified «owners of the garden» (q.v.; aṣḥāb al- janna) who swore (aqsamū) to harvest it on the next morning. They failed, however, to make istithnāʾ — understood to mean that they omitted to say in shāʾa llāh, "God willing, " after swearing. While they slept, an affliction sent by God befell the garden, and when they came to harvest the fruit they found that there was none left. Mutual recriminations and recognition of guilt followed. The parable has been read as a warning against pride (q.v.) or complacency (Speyer, Erzählungen, 426). In two passages (q 58:16 and 63:2) the hypocrites (munāfiqūn) are accused of making their oaths a junna, "shield, armor, " and turning others from the way of God (see path or way). These are interpreted as referring to the oaths or the ḥilf which the hypocrites of Medina (q.v.) had made with the Muslims, claiming that they were believers, in order to deflect the Muslims from the way of God, i.e. from the putting into practice of God’s commands regarding the People of the Book and the unbelievers, to which they should really have been subject. There are other allusions — especially in q 9 — to agreements guaranteed by oath between the qurʾānic community and its opponents (see community and society in the qurʾān), although here too the emphasis is on the possibility or likelihood that the opponents will break them. q 9:12-3: If the mushrikūn with whom you have made an agreement «undo their oaths after their agreement (in nakathū aymānahum min baʿdi ʿahdihim) and attack your religion, fight the imāms (see imām) of kufr. They have no oaths (innahum lā aymāna lahum)…. Will you not fight a people who have undone their oaths….» Traditional commentators associate the first twenty-nine verses of q 9 with the period following the con-¶ quest of Mecca (q.v.), when agreements previously made between the Prophet and non-Muslims in Arabia were ended — after a period of four months' grace — and non-Muslims were barred from the Meccan sanctuary (see kaʿba; politics and the qurʾān). The binding and loosing of oaths There are so many such references to the opponents swearing oaths (often «by God») that the qurʾānic texts must reflect a society in which the swearing of oaths was a stock feature of speech (see pre-islamic arabia and the qurʾān). q 2:224, «Do not make God an ʿurḍa to your oaths…» (see further below), and q 5:89, "preserve (wa-ḥfaẓū) your oaths, " are sometimes interpreted as injunctions against prolixity in the making of oaths. As in other societies where oath taking is an important part of everyday life, tension must have existed between, on the one hand, the idea that oaths were solemn undertakings which, once entered into, had to be kept and, on the other, an awareness that it was often impossible to keep an oath. In the latter case some way out had to be found. Various qurʾānic passages, taken together, seem to illustrate this tension. The verses which stress most strongly the need to honor oaths are probably q 5:89 (where wa-ḥfaẓū is more usually understood as «keep» in the sense of «fulfil») and q 16:91-2, 94. The latter repeat an injunction to fulfil the covenant of God (ʿahd Allāh) when it has been entered into (idhā ʿāhadtum) and not to break oaths (lā tanquḍū l- aymāna) after they have been affirmed. Breaking them is then likened to a woman who ruins her thread by untwisting (n-k-th) it, thus weakening it. A possible motive for breaking them is suggested by the phrase, «[Do not] take your oaths as a deception (dakhalan) between yourselves, one party ¶ (ummatun) being more numerous than another» (tattakhidhūna aymānakum dakhalan baynakum an takūna ummatun hiya arbā min ummatin). q 16:94 then echoes the first part of that last phrase, «Do not take your oaths as a dakhal between you.» Dakhal is generally glossed by words meaning «trick» or "deceit, " and a tribal practice of the Age of Ignorance (q.v.; jāhiliyya) is suggested as the reason why the oaths in question were sometimes broken: one of the contracting parties (a tribe or other social group) was induced to abandon the other by the appearance of a third party which was bigger and stronger (arbā is understood as meaning «more numerous»). Nevertheless, the passage is understood to contain a general principle: al-Ṭabarī, (d. 310/923; Tafsīr, xiv, 163-9), while not ruling out that there may have been an occasion of revelation (see occasions of revelation) about which it is impossible to be certain, nevertheless considers the ruling contained therein to be generally applicable (wa-inna l-āya kānat qad nazalat li-sabab min al-asbāb wa-yakūna l-ḥukm bihā ʿāmman fī kull mā kāna bi-maʿnā al-sabab alladhī nazalat fīhi). q 2:225 and 5:89, while they reassure us that God will not hold us responsible for al- laghw ("slips, " but see below) in our oaths, nevertheless stress that he will hold us responsible «for what your hearts (see heart) have acquired» (q 2:225) or «for that which you have contracted oaths» (q 5:89). Nevertheless, both of those verses recognize the possibility of al-laghw in an oath: God will not hold us liable for al-laghw in our oaths (lā yuʾākhidhukumu llāhu bi-l-laghwi fī aymānikum). The commentators disagree on the precise meaning of al-laghw fī l-aymāni but they agree that it refers to oaths which, because of the mental or physical state of the one swearing — for ¶ example he may be angry, making a joke, or involved in bargaining — or because the words used are inappropriate, are not binding. Other than appealing to the circumstances in which it had been made, the other obvious way out of an oath which had been sworn but which could not be kept is the kaffāra (see atonement), various forms of which are set out in q 5:89. Commentators and jurists differ regarding whether a kaffāra is necessary in the case of al- laghw fī l- aymān. Oaths (or vows) of abstention, made for ascetic or other reasons (see asceticism), may have been a particular problem. The reference to al-laghw in q 5:89 follows the previous verse’s command to «eat of what God has given you as lawful and good» (see lawful and unlawful; food and drink), while that in q 2:225 follows the injunction, «Do not make God an ʿurḍa to your oaths.» This latter verse raises questions of interpretation. It is often understood to mean that if there is the possibility of performing a good deed (see good deeds), you should not avoid doing so on the grounds that you have sworn something which you would have to violate in order to perform the good. If you have sworn such an oath, then you should violate it and make an act of atonement. Another interpretation cites the example of someone who declares that something God has made permissible is forbidden (q.v.) to him. This procedure of taḥrīm al-ḥalāl is also sometimes mentioned in discussions of the meaning of al-laghw. The Prophet himself is understood as having sworn such an oath. q 66:1 reads, «O Prophet, why do you declare forbidden what God has made lawful for you, seeking the pleasure of your wives (see wives of the prophet)…?» The following verse then goes on to say that God has made ¶ incumbent upon you (plural) the expiation (?) of your oaths (taḥillat aymānikum). Commentators explain these verses as references to an incident in which the Prophet undertook to avoid something which was not contrary to God’s law. Many versions talk of his expressing his determination to avoid sexual relations with a slave girl out of deference to one or two of his wives. Others refer to a certain drink or to honey (q.v.). God then made clear that it was not right that he should declare ḥarām what God had made ḥalāl. Although q 66:1 has a singular vocative addressed to the Prophet while q 66:2 is understood as addressed to the Muslims in general, the reports about the Prophet’s «declaring forbidden» tend to agree that it involved an oath. Whether the taḥrīm was in itself an oath, or whether it was made together with an oath, many reports refer to the Prophet’s «swearing» (ḥ-l-f and y-m-n) and to his having to make a kaffāra. Some, interpreting the taḥrīm as a renunciation of sexual relations, use the noun īlāʾ and the verb ālā. Questions concerning oaths and vows occupy considerable space in the classical works of Islamic law, and the qurʾānic materials are taken into account in the discussions. Typically oaths and vows are discussed under the heading kitāb al-aymān wa-l-nudhūr although īlāʾ and ẓihār are usually discussed mainly in the sections on divorce (kitāb al-ṭalāq).
, 75; LXVIII, 17; LXXXI, 15; LXXXIX; 5; XC и т. Д.)

Ḳasam (3,298 words) (a.), from the verb aḳsama, designates the oath in general. The word has two other synonyms, yamīn, and ḥalf . Ibn Rus̲h̲d (Bidāyat al-Mud̲j̲tahid, i, 394), wishing to emphasize their equivalence from the point of view of terminology, uses the three words without differentiation in the first paragraph of the kitāb al-aymān of his Bidāya . In fact, when he deals with the judiciary oath, custom has imposed the word yamīn [q.v.] and the verb ḥalafa almost exclusively. But even in that which concerns the extrajudiciary oath, with which the discussion that follows is concerned, the word yamīn has a tendency to supplant ḳasam . It is also a fact that, in the treatises of fiḳh, whichever school is considered, and in the collections of ḥadīt̲h̲ , the chapter dedicated to [extrajudiciary] oaths is almost always entitled bāb or faṣl al-aymān .
In the lines that follow, the judiciary oath will not be discussed; nevertheless, there will be occasion to consider, in the field of penal procedure, the ḳasāma, an oath pronounced fifty times, which, although connected with the judiciary oath, derives etymologically from the word ḳasam. The extrajudiciary oath is that by which a person binds himself to do or not to do a certain specific physical or juridical act, by invoking the name of God or one of the divine attributes (al-Raḥmān, al-Ḳādir, al-Nāṣir, etc.). At least, that is the definition that the works of fiḳh give of it, for, in the Ḳurʾān, the word ḳasam or the verb aḳsama, which figure expressly in the sūras of the Meccan period (6:109; 16:38; 56:75; 68:17; 81:15; 89:5; XC, etc.) or which are implied in many of the other sūra s of the same period, apply, in general, to the oaths pronounced by God himself, which are known to cause some difficulties for commentators of the Ḳurʾān. Already in the Medinan sūras, the word yamīn is frequently substituted for ḳasam (11, 225; v, 89) and marks the first stage of an evolution leading to the concept which becomes that of fiḳh with regard to extrajudiciary oaths which bring about voluntary bonds, while the verb aḳsama is still to be found in these Medinan sūras (for example, v, 53). The bond undertaken under oath is not, in general, a juridical obligation, in the sense that the one who has sworn to perform an act cannot be constrained judicially to carry it out. In a case where he did not respect his oath, he would be perjured (ḥint̲h̲), but it is then a matter of sin, a moral fault, for which he must account to God alone. Nevertheless, fiḳh, following very close to the Ḳurʾānic text (v, 39) provides ¶ him, in the hypothetical case where he has involuntarily broken his oath, with a means to put his conscience in order, that is, by expiation, kaffāra . Expiation for a broken oath may be to give sustenance to 10 paupers, to distribute clothing to them or to free a slave; and, if, through lack of resources, any of these expiations is not possible, the perjured man must fast for 3 days. These regulations, having been laid down in the Ḳurʾān, are evidently common to the teaching of all the Schools. The latter are all divided, however, on the methods of application of each of them. For example, should the fast last for 3 consecutive days? Yes, reply the Ḥanafīs and the Ḥanbalīs, but no, according to the Mālikīs and the S̲h̲āfiʿīs (Dimas̲h̲ḳī, Raḥmat al-Umma, ii, 79-80). The same divergences are found in that which concerns the quantity of food to be given to the poor, or the quality of the clothing which is distributed to them. It must be emphasized that, as with the oath itself, the expiation, which sanctions its non-execution, has no characteristic of juridical obligation, and no-one, not even the public authority, can constrain the perjured man to perform expiation. All This is laid out on a strictly moral and religious plane. The fuḳahāʾ were asked if it was not possible for someone, who had sworn to accomplish a certain act deliberately, to substitute the expiation for the performance of his oath, although nothing prevented him from accomplishing his vow. Strangely enough, the Ḥanafīs and Ḥanbalīs refuse him this option, a prohibition that is not in accordance with the character of vows freely consented to as with the oath and expiation. The statement of the jurists with regard to oaths (aymān) is, in form, very close to that which they adopt in that which concerns a real juridical act. Necessary capacity, conditions of form and substance, null and void formulas, moment of performance of the vow undertaken, effects of the suspensive condition, expedients (ḥiyal) to change the law, all would let us suppose that it was concerned with vows which, although unilateral, bound their author by strict juridical obligation. Certainly, a careful examination of the dispositions of each school on the question, and especially the non-juridical sanction, which consists of kaffāra, quickly restores to these dispositions their real character of strictly religious and moral rules. That is not to say that all the works of the jurists on the question were devoid of practical interest. Throughout the centuries, the pious Muslim did not generally attach great importance to the distinction, familiar to specialists, between moral and juridical sanction. His concern was to know whether his conduct here below was reprehensible or not, and whether it would bring him chastisement in the next world. So it was that the long discussions dedicated in the books of fiḳh to oaths (aymān) often associated with vows, nud̲h̲ūr [q.v. nad̲h̲r ] presented him with a very great interest. It is not possible to enter into detail on the solutions proposed by authors (different, moreover, according to the schools) for particular cases of oaths and all the kinds that were imagined. Only one example will be given because of the long discussions that the works of fiḳh dedicate to this particular case. It concerns the oath called ẓihār, which may be translated very vaguely as «incestuous comparison». The word is derived from ẓahr, «back». Presumably the husband says to his wife: «You are for me like my mother’s back», ka-ẓahri ummī , or any other comparison of a part of the body of his wife with that of a woman he could not marry without ¶ committing incest. In pre-Islamic Arabia it was a general form of repudiation, but the Ḳurʾān condemned everything of that kind (XXXIII, 4 and LVIII, 2-3). Its pronunciation constituted nothing other than a sin, and a serious one, which could only be wiped out by expiation. This is different from the ordinary expiation for oaths not respected, and consists of freeing a slave, or in default, fasting for 2 months (during the day only, of course). If not, the husband would have to distribute the midday and evening meal to 60 paupers. In a general manner, the solutions of fiḳh hinge on two essential points. In the first place, it is concerned with knowing when one may consider that an oath has been respected, the expressions used by the one who swore being borne in mind. On this point, the replies are very often of a lexicological order and baffle all systemization. The second point concerns expiation; This is not automatically incurred by the simple fact that the oath has not been performed. There are actually some oaths which, due to an actual or theoretical fault, do not call for expiation, although they have not been respected. It is in this category that one places the yamīn al-ghamūs, or oath to perform a deed that one knows to have been already performed. There would not be any kaffāra, except in the S̲h̲āfiʿī school. In the same way, the lag̲h̲w al-yamīn, an oath taken by mistake (through a slip of the tongue) or in a thoughtless manner, does not require expiation (Dimas̲h̲ḳī, op. cit., ii, 73). The same applies, if one follows an oath with an istit̲h̲nāʾ , a reservation, of which the most usual is «If God wills». No more can someone who is not mukallaf (fully capable) bind himself validly by oath, but the majority of the schools (except the Ḥanafī school) admit that the oath of the unbeliever (kāfir) is valid, and that he will be held liable to expiation if he does not carry out his vow. During the centuries, the usages, variable according to the regions, have added different ceremonials to the very simple form of the oath that was foreseen by fiḳh, in order to render the vow more solemn, and to bind further its author. There were also oaths pronounced in sacred places such as the Kaʿba at Mecca, or simply within a mosque, which conferred on them a higher value in popular belief. In the same fashion, oaths are sworn by touching the tomb of a saint or holding bread and coffee in the hand, or placing on the heart an excerpt from the Ḳurʾān or the Ṣaḥīḥ of Buk̲h̲ārī. Sometimes this supplementary ceremonial represents a pre-Islamic practice, still strongly marked by paganism, such as pronouncing the oath and throwing salt in the communal fire of the tribe, or within a circle in which cinders and pieces of fabric have been scattered. There are some moments of the day when oaths acquire a particular importance, such as that which follows the evening prayer. On all these practices which are unknown to fiḳh, see Musil, Arabia Petraea, 3/338, 342; Jaussen, Coutumes des Arabes au pays de Moab, 311; Landberg, Arabica, 5/133-4; Snouck Hurgronje, Mekka, 2/306; Lane, Manners and Customs, 1/168, 470. Oaths judicially sanctioned. As has been stated and repeated above, the whole theory of the extrajudiciary oath is placed on a moral and religious plane, and consequently very often means that the question may be treated in the first part of the works of fiḳh, dedicated to ritual (ʿibadāt). Nevertheless, in two fields of law, i.e. enfranchisement and repudiation, the oath involved in the past (and sometimes today) a juridical sanction, in the sense that ¶ the one who swore to free his slave or repudiate his wife was held liable to carry out his vow, without being able to substitute a kaffāra or expiation, through which he would have been able to free himself from his obligation. In the matter of enfranchisement, every declaration to this effect, even not dependent on the fulfilment of an act by the master or the slave or any other person, had the validity of an oath of enfranchisement, al-ḥalf bi’l-ʿitḳ) and this oath (which did not, however, mention the name of God) irrevocably entailed the liberty of the slave or the slaves alluded to in the master’s declaration. Ancient fiḳh had set up two institutions both based on an oath which, although not having as principal object the breaking-up of marriage, led indirectly to This result. The first of these institutions is the liʿān, or «oath of anathema», by which the husband accuses his wife of adultery or disowns the child that she carries in her womb. To This end, the husband prayed five times an oath in the form as̲h̲hadu bi-llāhi, and the last oath was followed by the formula «may I be cursed, if I lie». The īlāʾ was an «oath of continence», the husband swearing in the name of God not to have sexual relations with his wife for at least 4 months. When this time had passed without a resumption of conjugal relations, the marriage was not automatically broken up except in Ḥanafī law, the other schools allowing the wife to judge the occasion for the severance, which would take place by a repudiation that the husband would pronounce, or that the ḳāḍī would formulate in his place. Very soon the rules of precedent, especially those relating to the īlāʾ, had fallen into desuetude. The jurists do not dedicate very long discussions to them, except on account of the importance of the scriptural evidence relating to these two institutions, and not for their usefulness, which had become practically nil. The oath of repudiation. On the other hand, the oath of repudiation, al-ḥalf bi’l-ṭalāḳ or still more al-yamīn bi’l-ṭalāḳ , has always been in very current usage among the Arabic-speaking Muslim populations. In certain circles, notably that of the small traders, it is not rare in the course of a conversation for one of the speakers to swear two or three times, in order to assert his determination or his good faith: «May my wife be repudiated if such a thing does or does not happen, if I am right or if I am wrong, etc.». The matters are of no consequence, each one knowing that he is uttering idle words, pronounced mechanically and without attention being paid to them. The moralists have always severely reproved This bad habit, for, in any case, it leads to a blameworthy result, whether the one who has sworn does not respect his oath on the pretext that he had formulated it without a serious intention to repudiate and he finds himself perjured, often several times a day, or whether he respects it and separates from his wife, from whom he had no intention to separate and whom he had no occasion to reproach. What juridical validity did the jurists attach to these oaths of repudiation? Only the Ḏj̲aʿfarīs (and the Ẓāhirīs in the past) have always denied them all legal validity, for the reason, among others, that they do not contain the name of God in their formulation. The other juridical schools regard them as conditional repudiations, and as such, involving the break-up of the marriage, when the condition is realized. Whether the wife avails herself or not of the oath or the husband respects it in separating from his wife or does not respect it in continuing to live ¶ with her, are questions of fact, which do not modify at all the principle itself, i.e. the oath of repudiation determines, in law, the repudiation of the wife, if the tacit or explicit condition that it contains is realized. This troublesome solution of the jurists is still applied today in a certain number of Muslim countries. Egypt is the first Muslim state to have attempted to restrain the execution of the rule of precedent. The Egyptian law of 10 March 1929 declares as null and void conditional repudiations and oaths of repudiation, when these are dependent on an act being done or not done by the wife; but if the condition is different (i.e. if it is not dependent on the will of the wife) the oath of repudiation is valid. Several Muslim countries (Sudan, Jordan, Syria) have adopted in their turn the Egyptian distinction. One must turn to the Moroccan Code of the Personal Statute of 1958 and the Iraqi Code of the Personal Statute of 1959 to find a radical condemnation of every oath of repudiation, whatever may be the nature of the condition on which the repudiation is dependent.
Derived etymologically from ḳasam , This differs from it in its mode of being taken and its strict field of application. It is concerned with an oath repeated 50 times, either by the ʿaṣaba of the victim of a murder (Mālikī rite), or by the inhabitants of the place of the crime (Ḥanafī rite) an oath by which is asserted the guilt or, on the contrary, the innocence of an individual presumed to have killed someone. This oath dates from the pre-Islamic period, when it always constituted a procedure of accusation, a weapon in the hands of the members of the victim’s tribe, seeking to make use of retaliation (ḳiṣāṣ) against the man presumed to be guilty. The juridical schools of Islam, in adopting This pre-Islamic custom, do not make it produce the same result. Actually, in fiḳh—merely quoting the Ḥanafī and Mālikī doctrines which are clearly opposed—the ḳasāma is, in the first of these systems, a procedure for the defence of the one presumed guilty, and, in the second, a procedure of accusation. According to all the early Ḥanafīs (sc. those of Kūfa), when in a non-public place (which excludes the mosque), quarter of a town, house, boat, etc., the corpse of a person was discovered, when there were not two male witnesses to point out the murderer, and when the walī al-dam, the nearest ʿāṣib relative of the victim, came to demand justice, 50 people had to be made to swear to having found it in This place, that they were not involved in This crime and that they did not know the murderer. If 50 people could not be gathered (if the crime was committed in a house, for example), it was possible to make the same person swear several times, in such a manner that the total of 50 oaths was reached. In the light of this, the walī al-dam could not apply retaliation and had to content himself with the pecuniary compensation (diya) provided in such a case. The Mālikī school, following the teaching of the scholars of Medina, has kept the characteristics of the ḳasāma which it had in pre-Islamic Arabia, that is to say, those of a procedure of accusation. It is also a fact that in the hypothetical case of a murder of which the author is unknown, the ʿaṣaba relatives of the victim swore a total of 50 oaths (the same person could swear several times provided that this was not more than 25 times) that such an individual, against whom is weighted serious presumptive evidence, ¶ was the one who committed the murder. The notion of serious presumption (lawt̲h̲) has acquired thereby in this school, and in those that have adopted the same conception of ḳasāma, a fundamental importance. Serious presumptive evidence was held to be not only the fact that the victim, before dying, had accused the presumed murderer, but also the presence of this last person, with his bloodstained clothing, not far from the victim, or even the testimony of a single witness to the murder. With these conditions combined, the walī al-dam would bring retaliation against the one presumed guilty, such that he could then, as a result, have him put to death. The Mālikī version of the ḳasāma, in which oaths liable to bring about death were taken by the relatives of the victim who, ex hypothesi, were not present at the murder, has formed the subject of some criticisms on behalf of one party, that has nevertheless remained a minority, of the ancient doctrine (Ibn Rus̲h̲d, Bidāya, ii, 419). Finally, it does not appear that this institution functioned much, even in the past when the penal law of Islam had a certain practical application. |
